On March 12, 1980, Robert Creekpaum allegedly sexually assaulted a nine year old girl. On May 17, 1985, a grand jury in Juneau returned an indictment against Creekpaum for "a class A felony . . . in violation of AS 11.41.410(a)." Creekpaum filed a motion to dismiss the case on June 20, 1985, on the grounds that the applicable statute of limitations had run and the indictment was untimely.
